1. Personal data controller

The operator of personal data, ie the entity that processes the personal data of the data subject, is the company SaluD, sro, Bošácka 8, 915 01 Nové Mesto nad Váhom, ID number: 36347001, registered in the Commercial Register of the Trenčín District Court.  15954 / R hereinafter referred to as the "Operator").

The Operator proceeds with the processing of personal data in accordance with Act 122/2013 Coll. on the protection of personal data, v  wording of later regulations and other legal regulations (hereinafter referred to as “Act No. 122/2013 Coll.”). From 25.5.2018, the Operator will replace the law no. 122/2013 Coll. To manage the personal data of data subjects by Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation) and  Act no. 18/2018 Coll., P  personal data protection and  about  change a  amendments to some laws.

2. Purposes a  legal basis for the processing of personal data

and in  in the event of the existence of a contractual relationship between the person concerned and  Operator, the Operator processes the personal data of the persons concerned on the basis of the legal title of the contract, exclusively in  to the extent necessary to fulfill the purposes of this Treaty.

b) The Operator processes the personal data of the persons concerned in the ordering system and for the purpose of informing about news and  important facts on the basis of the legal title of the legitimate interest or consent of the person concerned, exclusively in  name, surname, year of birth, e-mail and telephone,  whose processing is necessary to achieve that.

c) V  In the event that the person concerned voluntarily notifies the Operator of his personal data without prior action of the Operator, such personal data will be processed by the Operator in  to the extent necessary on the basis of the legal title of the legitimate interest (in particular for the purpose of assessing the application of the person concerned and  provide an answer to the data subject).

3. Retention period of personal data

All personal data are processed only to the extent necessary to fulfill the purposes stated in  point 2 of these Conditions and only for the time necessary to achieve the stated purposes, but no longer than the period specified by the relevant legislation or in accordance with them.

Personal data processed by the Operator from  the legal title of the data subject's consent are processed until the consent is revoked. However, the controller may process some of this data even after revoking the consent, if it has another legal reason to do so (eg to prove the accuracy and  the lawfulness of the procedure for the processing of personal data or for the possibility of defending against legal claims).

Personal data processed by the Operator from  legal title of legitimate interest or personal data processed by the Operator for the purpose of direct marketing are processed until the objection of the person concerned against the processing of his personal data.

4. Identification of recipients of personal data

The controller may make the personal data of the data subjects available to third parties only in cases where this is required or permitted by law or with the consent of the data subject. The operator makes personal data available only to the usual extent to processors or other recipients:

a) suppliers of external services for the Operator (especially programming or other support technical services, server services, e-mail distribution, services related to measuring traffic to our sites and adapting their content to user preferences),

b) operators of backup servers or operators of technologies used by the Operator, who process them to ensure the functionality of the relevant services of the Operator,

c) to the extent necessary, the legal, economic and tax advisors of the Operator and the auditors of the Operator, who process them for the purpose of providing advisory services to the Operator.

5. Rights of the persons concerned

(a) The person concerned shall have the right to request confirmation from the Operator upon request  whether or not the personal data of the data subject are processed, and  in  if necessary, request information on  processing of personal data concerning the data subject.

b)  The data subject has the right to rectify the personal data concerning him and  taking into account the purpose of the processing of personal data and the addition of incomplete personal data.

c) V  in the case of the processing of personal data from  the legal title of the contract or of  the legal title of the data subject, the data subject shall have the right to the transfer of personal data concerning him or her; and  provided to the Operator, and  this in a structured, commonly used readable format if the personal data of the data subject are processed in an automated form and before the expiry of the personal data retention period. The exercise of this right must not adversely affect the rights of others.

d) The data subject has the right to the destruction of personal data (right to delete personal data) which are the subject of processing if:

  • personal data are processed in  contrary to the law or

  • upon revocation of the consent of the data subject (in the case of the processing of personal data from  the legal title of the consent of the person concerned) or

  • the data subject objects to the processing of personal data processed by  the legal title of the Operator 's legitimate interest and  the Operator 's legitimate reasons for processing personal data do not prevail; or

  • personal data are no longer required for the purpose for which they were obtained or for which they were otherwise processed; or

  • after the retention period of personal data.

The right to the destruction of personal data according to point 5 letter d) does not apply if the processing of personal data is necessary for the Operator to:

  • the exercise of the right to freedom of expression or

  • exercise of the right to information,

  • fulfillment of obligations according to Act no. 18/2018 o  personal data protection and  about  change a  amendment of other laws (effective from 25.5.2018) or a special regulation,

  • assertion of a legal claim,

  • for the purpose of archiving, for a scientific purpose, for the purpose of historical research or for a statistical purpose according to § 78 par. 8, where the law referred to in paragraph 1 is likely to make it impossible or seriously difficult to achieve the objectives of such processing.

e) The right to restrict the processing of personal data if:

  • the data subject objects to the accuracy of the personal data during the period allowing the Operator to verify the accuracy of the personal data and  possible updating of personal data,

  • the processing of personal data is illegal and the data subject objects to the deletion of personal data and calls instead for restrictions on their use,

  • The controller no longer needs personal data for the purpose of processing personal data, but the data subject needs them in order to exercise a legal claim, or

  • the data subject objects to the processing of personal data pursuant to § 27 para. 1 of Act no. 18/2018 o  personal data protection and  about  change a  amendments to other laws (effective from 25 May 2018), until verification that the legitimate reasons on the part of the operator outweigh the legitimate reasons of the person concerned.

f) Right to object to the processing of personal data:

  • the data subject has the right to object to the processing of personal data concerning him or her in all cases,  where the legal title of personal data processing is the legitimate interest of the Operator,

  • the data subject has the right to object to the processing of personal data concerning him or her in  where such personal data are processed for direct marketing purposes, including profiling, v  scope, v  how it relates to  direct marketing.

g) In case of suspicion that personal data are being processed unjustifiably, the data subject has the right to submit a request for the initiation of personal data protection proceedings to the Office for Personal Data Protection.

h) If the legal reason for processing the personal data of the data subject is his or her consent, the data subject may withdraw such consent at any time free of charge at the email address below. Withdrawal of consent shall not affect the lawfulness of the processing resulting from the consent given before its withdrawal.
